By entering this Contest, you agree to these Official Rules (“Official Rules”), which are a contract, so read them carefully before entering. Without limitation, this contract includes indemnities to Sponsor from you, a limitation of your rights and remedies, binding arbitration of claims, waiver of class action claims, and waiver of the right to trial by jury.
Valid email address and internet access required. Potential Finalists and the Grand Winner may be required to respond to Sponsor’s notification and other communications from Sponsor (defined below) within five (5) days according to the notice(s) from Sponsor or the opportunity to advance or the prize may be forfeited (in Sponsor’s sole discretion).
OVERVIEW: The Ultimate Mark Rober Rivian Contest (“Contest”) is sponsored by Rivian, LLC, 14600 Myford Rd., Irvine, California 92606 (“Sponsor”). Eligible individuals (defined below) may enter between 09:00:00 AM Pacific Time (“PT”) on June 22, 2026 and 11:59:59 PM PT on July 10, 2026 ("Entry Period"). Entries received in accordance with these Official Rules will be evaluated by a panel of Sponsor selected judges in accordance with the judging procedures detailed under the “Winner Selection/Notification” section, below. By participating in this Contest, you agree that your Entry (as defined below) and elements thereof may be used by Sponsor for marketing and promotional purposes, including being featured on Sponsor’s social media pages, as described in further detail in the “License” section below.
ELIGIBILITY: This Contest is open only to legal residents of any one (1) of the fifty (50) United States or the District of Columbia (the "Territory") who are at least eighteen (18) and the age of majority in their state or jurisdiction of primary residence under applicable law on the date of entry into this Contest. Each such eligible individual who takes action to submit an Entry in this Contest will be referred to in these Official Rules as an “Entrant”. By entering this Contest, each Entrant represents and warrants that they are: (i) the parent or legal guardian of the child artist entering kindergarten through eighth (8th) grade in the fall (“Artist”) whose drawing is being submitted, and (ii) submitting the Entry on behalf of both themself and the Artist. Each Entrant accepts these Official Rules on their own behalf and on behalf of their Artist. This Contest is void outside of the Territory and where prohibited by law.
Each Entrant acknowledges that by submitting an Entry, each Entrant represents and warrants that they are the parent or legal guardian of the Artist and are providing contractual authorization for Sponsor to collect and process the limited, non-personally identifiable demographic information of the Artist (e.g., the child's first initial, grade (Fall 2026), and artwork). Entrant explicitly agrees that the Entry must not contain the Artist’s full name, image, face, voice, or any other personally identifiable information. Any Entry that includes identifying personal information of a minor will be deemed ineligible and disqualified from the Contest. This Contest is designed to collect only non-personally identifiable information as stated by the parent or legal guardian about the Artist. Sponsor will not condition participation on the disclosure of more information than is reasonably necessary. Entrants may at any time request the deletion of the Entry or revoke this authorization by contacting Sponsor at ultimateroberrivian@rivian.com, with the understanding that revocation of consent may result in disqualification from the Contest.
PERSONAL DATA. By entering this Contest, each Entrant acknowledges and agrees that Sponsor will collect, use, and store certain personal information about the Entrant (such as name, email address, mailing address, and other information provided in connection with the Entry) for the purpose of administering the Contest, verifying eligibility, selecting and notifying the Winner, and fulfilling the prize. Sponsor will handle Entrant personal information in accordance with its Privacy Policy, available at https://rivian.com/privacy. Entrant personal information will not be shared with third parties except as necessary to administer the Contest or as required by applicable law. Sponsor will retain Entrant personal information only for as long as reasonably necessary to fulfill the purposes described herein or as required by law, after which it will be deleted or anonymized. Entrants who are California residents may have additional rights with respect to their personal information under the California Consumer Privacy Act ("CCPA"), as described in Sponsor's Privacy Policy. By entering the Contest, each Entrant consents to the collection, use, and storage of their personal information as described in these Official Rules and Sponsor's Privacy Policy.
HOW TO ENTER: During the Entry Period, eligible Entrants may submit a drawing illustrating their eligible Artist’s idea and design for a fun accessory to incorporate into an R2 relating to the “Ultimate Mark Rober” theme (“Idea”). To enter, complete the following steps:
1. Download the R2 blank template from http://events.rivian.com/rober, or create your own R2 on an 8 ½ x 11 white paper.
2. Have your Artist draw their Idea on the template.
3. Take a photo of your Artist’s Idea.
4. Upload your drawing, contact information, narrative summary of the Idea, and all other information required on the Entry form at http://events.rivian.com/rober during the Entry Period.
Each Idea, submitted along with a complete Entry form, will count as one (1) Entry. Limit one (1) entry per individual Entrant (and Artist). All Entries must comply with the "Submission Requirements" detailed below and otherwise comply with these Official Rules. Once an Entry is actually received by Sponsor, it is referred to in these Official Rules as an "Entry” or “Entries”, as applicable.
Sponsor’s clock will be the official timekeeper for this Contest. Entries must be submitted and received by Sponsor during the Entry Period and all participation must be in strict accordance with the instructions and restrictions in these Official Rules. For purposes of this Contest, only Entries that are actually received and recorded during the Entry Period will be considered. Other proof of submitting or attempting to submit an Entry (such as, without limitation, a printed, saved or copied automated receipt confirming entry or a "Thanks for submitting" screen or message) does not constitute proof of actual receipt of the Entry for purposes of this Contest. Entries will not be accepted in-person at Rivian Spaces. Those who do not abide by these Official Rules and the instructions of Sponsor may, in Sponsor’s sole discretion, be disqualified. Entries (or participation that does not qualify as an “Entry”) that are incomplete, lost, late, misdirected, mutilated, fraudulent, illegitimate, incomprehensible, garbled, or generated by a macro, bot, or other automated means will not be accepted and will be void. Entries or participation made on behalf of an Entrant or Artist by a third party not affiliated or associated with that Entrant or Artist (as determined by Sponsor in its sole discretion) or originating through any commercial promotion subscription, notification, or participating services will be declared invalid and disqualified for this Contest. Sponsor will not have any responsibility or liability for any dispute regarding any Entrant or Artist. In the event that any dispute regarding an Entry, Entrant, Artist, or Idea cannot be resolved to Sponsor's satisfaction, the Entry will be deemed ineligible and the Entrant disqualified. As a condition of participating in the Contest, without limiting any other provision in these Official Rules, each Entrant gives consent for Sponsor and its agents to obtain and deliver their name, address and other information, including their Entry content, to third parties for the purpose of administering this Contest and complying with applicable laws, regulations, and rules. Entries or participation may not be acknowledged or returned. In fact, Entries may be destroyed after the Entry Period. Keep a copy or the original of each Entry. Any Entry that does not conform to the requirements in these Official Rules may, in Sponsor’s sole discretion, be deemed ineligible.
SUBMISSION REQUIREMENTS: All Entries must meet all of the following requirements or the associated Entry may be disqualified, as determined by Sponsor in its sole discretion:
- Entries must relate to the “Ultimate Mark Rober Rivian” theme.
- Entries must be PDF or JPEG format.
- Entries must be in English.
- Entries must be original to the Artist (or include content that is in the public domain) and must not infringe upon the rights of any third parties. No other person or entity may have rights to any Entry.
- Entries must depict the artwork only. Entries must not depict or include any identifiable person (e.g., no images/faces of the Artist or any other individual, no voices, no videos), and must not contain any personal information (do not include full name, written signature, email address, or school of the Artist or any other person)
- Entries must not infringe, misappropriate, plagiarize, or violate any rights of any third-party including, without limitation, copyright (including moral rights), trademark, trade secret, or rights of privacy or publicity.
- Entries must not include information or content that is false, fraudulent, deceptive, misleading, defamatory, libelous (including trade libel), disparaging, harassing, threatening, profane, obscene, pornographic or otherwise adult-oriented, hateful, indecent, inappropriate, hurtful of religious sentiments, or injurious to any Sponsor or any other party.
- Entries must not contain or describe any harmful or illegal activity or content or in any way violate any federal, state, or local laws, rules, or regulations.
- Entries must be suitable for presentation in a public forum.
- Entries must be unpublished prior to being submitted as part of the Contest and may not have been entered into any other contest, sweepstakes, promotion, or competition or otherwise distributed in any way. Entry must not be publicly displayed during the Entry Period except according to these Official Rules.
- Entries must not create or imply any association between Sponsor and any individual, entity, or anyone else or their or its products and services.
- Entries must not contain any commercial or corporate advertising (including, without limitation, corporate logos, brand names, and slogans), recognizable branded products, or commercial artwork, except that of Sponsor.
- You agree that your participation in this Contest and agreement to these Official Rules will not violate any agreement to which you, or your Artist, are a signatory or party and that no such agreement otherwise limits your ability or your Artist’s ability to participate in this Contest or grant the rights granted by you in these Official Rules.
- You agree to indemnify Sponsor against any loss or expense that Sponsor may sustain or incur on account of any and all claims from any third-party for any use by any Sponsor of the Entry authorized pursuant to these Official Rules.
WINNER SELECTION/NOTIFICATION: The Contest will consist of two (2) distinct phases of judging:
Phase 1 - Finalist Selection: At the end of the Entry Period, Entries will be judged by a panel of judges chosen by Sponsor in their sole discretion (“Judges”). The Judges will use the following criteria according to the percentage weights indicated to evaluate the Entries to select five (5) finalists (each, a “Finalist” and collectively, the “Finalists”):
- Feasibility / Manufacturability: 40%
- Creativity: 30%
- Relevance to the brand: 30%
Phase 2 - Final Round of Judging: The five (5) selected Finalists will move on to a final round of judging of their drawings and ideas. This round of judging will involve a mandatory video conference with the Artist and the Entrant, where the child will be asked to explain their idea to Sponsor’s team in more detail. A panel of judges (“Judges”) will evaluate the Finalists during this phase based on the following criteria:
- Design: 50%
- Implementation: 50%
As a condition of being confirmed as a finalist and advancing to Phase 2, the Entrant (parent/legal guardian) must provide and execute verifiable parental consent and a media release, in a form designated by Sponsor to collect data on and photograph and/or film their child (Artist), and to publicly display and distribute such images and recordings in connection with the Contest and the final round of administration, judging, and promotion.
One (1) potential grand winner will be selected from the final round and will be notified on or about September 30, 2026. All Judges’ decisions are final and binding in all matters relating to this Contest. Each Entrant acknowledges that other Entrants may have created ideas and concepts contained in their Entry that may have similarities to their Entry, and that they will not be entitled to any compensation or right to negotiate with Sponsor because of these similarities.
In the event of a tie, the Entry with the higher score in the implementation criteria will be deemed the Winner. If there is still a tie, the Entry with the higher score in the design criteria will be deemed the Winner. If there is still a tie, the Judges will vote on the Winner.
Sponsor reserves the right to contact Entrants for verification purposes and administration of the Contest. The grand winner will be chosen as specifically described, and not using any random drawing or method incorporating chance. If no Entries meet the Judges’ minimal requirements for winning and/or do not adhere to the Submission Requirements, no Entries will be selected. In order to be confirmed as the Grand Winner, the Entrant (the parent/legal guardian) must provide verifiable parental consent and an explicit publicity release permitting Sponsor to film, photograph, and publicly broadcast the Artist’s image, voice and likeness worldwide in perpetuity. Additionally, the parent/legal guardian will be required to execute an additional agreement granting Sponsor an irrevocable, exclusive license and all necessary rights to physically build, modify, and publicly showcase their child’s design, along with any other documents that Sponsor deems necessary, including, without limitation, pursuant to local, state or federal laws or requirements.
PRIZE: One (1) Grand Winner, subject to verification, will have their idea actually built into a physical build by Mark Rober’s team and/or Rivian. No prizes will be awarded during the Finalist Selection phase.
All prize details not specifically stated in these Official Rules will be determined by Sponsor in its sole discretion. All taxes (national/federal, state/territorial, and local), as well as any expenses not specified in these Official Rules as being provided as part of the prize, are the sole responsibility of Winner. Mailed prize elements will only be mailed to a confirmed winner’s address in the Territory, unless otherwise agreed to by Sponsor. Sponsor is not responsible for and will not replace any lost, mutilated, or stolen prize or prize component, or any prize/prize component that is undeliverable or does not reach Winner because of incorrect or changed contact information. If Winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited and Sponsor will have no further obligation with respect to the prize or portion of the prize. Sponsor is not responsible for any inability of any Winner to accept or use any prize (or portion thereof) for any reason. Winner is strictly prohibited from selling, auctioning, trading or otherwise transferring any part of a prize, except with Sponsor’s permission, which may be granted or withheld for any reason in its sole discretion. No transfers, prize substitutions or cash redemptions will be made, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute any stated prize or portion thereof with another prize or portion thereof of equal or greater value for any reason, including, without limitation, prize unavailability. No more than the stated prizes will be awarded. Entrants waive the right to assert, as a cost of winning any prize, any and all costs of verification and redemption or travel to claim the prize and any liability and publicity which might arise from claiming or seeking to claim said prize.
LIMITATION OF LIABILITY: To the fullest extent permitted under applicable law, each Entrant agrees to release, hold harmless, and indemnify Sponsor from and against any liability whatsoever for injuries or damages of any kind sustained in connection with the acceptance, use, misuse, or awarding of the prize or while preparing for, participating in, and/or traveling to or from any prize- or Contest-related activity including, without limitation, any injury, damage, loss, death or accident to/of person or property. The limitations set forth in this section will not limit or exclude Sponsor’s liability for personal injury or tangible property damage caused by Sponsor, or for Sponsor’s gross negligence, fraud, or intentional, willful, malicious, or reckless misconduct.
To the fullest extent permitted by applicable law, Winner agrees that the prize is provided as-is without any warranty, representation, or guarantee, express or implied, in fact or in law, whether now known or hereinafter enacted, relative to the use or enjoyment of the prize, including, without limitation, its quality, merchantability, or fitness for a particular purpose.
Each Entrant understands and agrees that all rights under section 1542 of the Civil Code of California and any similar law of any state or territory of the United States are hereby expressly waived by them. Section 1542 reads as follows:
A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
ADDITIONAL DISCLAIMERS: The Grand Prize will be awarded to the holder of the email address used for, or identified in, the Entry. The potential Grand Winner (and/or Finalists) may be required to provide Sponsor with proof that they are the registered account holder of the email address used in connection with the potentially winning Entry. If a dispute regarding the identity of the holder of the email address cannot be resolved to Sponsor’s satisfaction, the Entry will be deemed ineligible. Sponsor is not responsible and/or liable for any of the following, whether caused by Sponsor, an Entrant, or by human error: Entries, or purported entries, that are submitted by illegitimate means (such as, without limitation, by an automated computer program); any lost, late, incomplete, illegible, unintelligible, inaccurate, faulty, failed, garbled, mutilated, or misdirected Entries, email, mail, or Contest-related correspondence or materials or postage-due mail; any error, omission, interruption, defect or delay in transmission or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable, or satellite systems; errors, typos, or misprints in these Official Rules, in any Contest-related advertisements or other materials; failures of electronic equipment, computer hardware, or software; lost or unavailable network connections; failed, or inaccurate transmission of, or failure to receive any information on account of technical problems or failure of any Internet service providers, traffic congestion on the Internet, a server, or at any website or any combination thereof, which may limit a person’s ability to participate in this Contest or receive communication from Sponsor. Sponsor is not responsible for any electronic communications that are undeliverable or do not reach any Entrant as a result of any form of active or passive filtering of any kind, or insufficient space in a person’s email account or voicemail inbox to receive messages. Sponsor is not responsible, and may disqualify you, if your email address, or other contact information does not work or is changed without prior written notice to Sponsor. Without limiting any other provision in these Official Rules, Sponsor is not responsible or liable to any Entrant or Winner or any person claiming through such Entrant or Winner for failure to supply the prize or any part thereof in the event that any of the Contest activities or Sponsor’s operations or activities are affected by any cause or event beyond the sole and reasonable control of the applicable Sponsor (as determined by Sponsor in its sole discretion), including, without limitation, by reason of any acts of God, equipment failure, threatened or actual terrorist acts, air raid, act of public enemy, war (declared or undeclared), civil disturbance, insurrection, riot, epidemic, fire, explosion, earthquake, flood, hurricane, unusually severe weather, blackout, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, any law, rule, regulation, action, order, or request adopted, taken, or made by any governmental or quasi-governmental entity (whether or not such governmental act proves to be invalid), or any other cause, whether or not specifically mentioned above.
LICENSE: By entering the Contest, except where prohibited by law, each Entrant, on behalf of themself and their Artist, grants to Sponsor (and their agents, successors and assigns) a worldwide, royalty-free, fully paid-up, irrevocable, sublicensable, absolute and perpetual license to use, edit, modify, copy, adapt, create derivative works of, publish, and exploit the Entry(ies) and any underlying intellectual property therein, in any and all media now existing or hereafter devised (including online) throughout the world, in any language, and in any manner for trade, advertising, promotional, commercial, or any other purposes, without further review, notice, approval, consideration, or compensation beyond the opportunity to win a prize in this Contest. Each Entrant waives and releases Sponsor from any and all claims that Entrant may now or hereafter have in any jurisdiction based on "moral rights" or "droit moral" or unfair competition with respect to Sponsor’s exploitation of any Entry(ies) without further notification or compensation to Entrant of any kind, and agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor, each of their licensees, or any other person in connection with this Contest, on the grounds that any use of any Entry(ies) or element thereof or derivative works therefrom in accordance with this license infringes or violates any of Entrant’s rights (including MORAL RIGHTS) therein.
Each Entrant hereby acknowledges and agrees that the relationship between the Entrant and Sponsor is not a confidential, fiduciary, or other special relationship, and that the Entrant’s decision to submit their (and their Artist’s) Entry for purposes of the Contest does not place any of Sponsor in a position that is any different from the position held by members of the general public with regard to elements of the Entry, other than as set forth in these Official Rules. Each Entrant understands and acknowledges that Sponsor has wide access to ideas, images, and other creative materials. Each Entrant also acknowledges that many ideas or images may be competitive with, similar to, or identical to their Entry and/or each other in idea, components, format, or other respects. Each Entrant acknowledges and agrees that neither such Entrant nor Artist will be entitled to any compensation as a result of Sponsor’s use of any such similar or identical material that has or may come to Sponsor from other sources. Each Entrant acknowledges and agrees that Sponsor does not now, and will not have in the future, any duty or liability (direct or indirect; vicarious, contributory, or otherwise) with respect to the infringement or protection of the Entrant’s copyright in and to their Entry or its constituent elements. Each Entrant acknowledges that, with respect to any claim by Entrant relating to or arising out of a Sponsor’s actual or alleged exploitation or use of any Entry(ies) or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such Entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition, or other exploitation of any Sponsor property or product, and Entrant’s rights and remedies in any such event are strictly limited to the right to recover damages, if any, in an action at law.
GENERAL RULES: By entering the Contest (except where prohibited by law), each Entrant grants Sponsor the irrevocable, sublicensable, absolute right and permission to use, publish, post or display the Entrant’s (adult parent/guardian) name, photograph, likeness, voice, prize information, biographical information, any quotes attributable to them, any other indicia of persona, and any information or content provided in or as part of their Entry, including the Idea, (regardless of whether altered, changed, modified, edited, used alone, or used with other material in Sponsor’s sole discretion) for advertising, trade, promotional and publicity purposes without further obligation or compensation of any kind to them, anywhere, in any medium now known or hereafter discovered or devised (including, without limitation, on the Internet), world-wide, without any limitation of time, and without notice, review, or approval and each Entrant releases all Sponsor from any and all liability related thereto. Nothing contained in these Official Rules obligates Sponsor to make use of any of the rights granted herein and Entrants waive any right to inspect or approve any such use.
Sponsor’s decisions will be final in all matters relating to this Contest, including interpretation of these Official Rules, determination of the Winner, and awarding of the prize. All Entrants, as a condition of entry, agree to be bound by these Official Rules and the decisions of Sponsor. Failure to comply with these Official Rules may result in disqualification from this Contest. Entrants further agree not to damage or cause interruption of the Contest and/or prevent others from participating in the Contest. Sponsor reserves the right to restrict or void entries or participation from any IP address or other identifiable source if any suspicious participation is detected. Sponsor reserves the right, in its sole discretion, to void Entries of any Entrants who Sponsor believes have attempted to tamper with or impair the administration, security, fairness, or proper play of this Contest. Sponsor’s failure to, or decision not to, enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. If there is an alleged or actual ambiguity, discrepancy, or inconsistency between disclosures or other statements contained in any Contest-related materials and/or these Official Rules (including any alleged discrepancy or inconsistency within these Official Rules), it will be resolved by Sponsor in its sole discretion. Entrants waive any right to claim ambiguity in the Contest structure or these Official Rules. If Sponsor determines, at any time and in its sole discretion, that the Winner or a potential Winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to disqualify the Winner or potential Winner, even if the disqualified Winner or potential Winner may have been notified, displayed, or announced anywhere. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their Official Rules as if the invalid or illegal provision were not contained herein. If the Contest is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest and award the prize from eligible Entries received prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor. If any person supplies false information, obtains Entries by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain a prize, Sponsor may disqualify that person and seek damages from them and that person may be prosecuted to the full extent of the law. CAUTION: Any attempt to damage any online service or website or to undermine the legitimate operation of the Contest may violate criminal and civil laws. If such an attempt is made, Sponsor may disqualify any Entrant making such attempt and may seek damages to the fullest extent permitted by law.
GOVERNING LAW/DISPUTES/ARBITRATION: You agree that these Official Rules and your participation in the Contest are governed by the law of the state of California excluding its conflicts of laws principles. The arbitration proceedings shall be governed by federal arbitration law and by the JAMS (defined below) rules. Both you and Sponsor waive the right to a trial by jury and the right to bring or resolve any dispute as a class, consolidated, representative, collective, or private attorney general action. Notwithstanding any provision in the JAMS rules to the contrary, the arbitrator shall not have the authority or any jurisdiction to hear the arbitration as a class, consolidated, representative, collective, or private attorney general action or to consolidate, join, or otherwise combine the claims of different persons into one proceeding.
You and Sponsor each agree to finally settle all disputes only through arbitration; provided, however, Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts located in or having jurisdiction over Orange County, California and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Contest will be resolved solely by binding arbitration before a sole arbitrator under the streamlined arbitration rules & procedures of JAMS Inc. ("JAMS") or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a "demand for arbitration," then either party can elect to have the arbitration administered by another mutually agreeable arbitration administration service that will hear the case. If an in-person hearing is required, then it will take place in Minneapolis, MN, Chicago, IL, New York City, NY, Los Angeles, CA, Atlanta, GA or Dallas, TX (whichever is closest to your residence) or your hometown area (but only if required by the JAMS rules). The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions or class arbitrations; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate does not apply and the dispute must be brought in a court of competent jurisdiction in Orange County, California. Sponsor agrees to pay the administrative and arbitrator's fees in order to conduct the arbitration (but specifically excluding any travel or other costs of Entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court. In no event will you seek or be entitled to rescission, injunctive or other equitable relief or to enjoin or restrain the operation or exploitation of the Contest or any other property of Sponsor.
Further, in any such dispute, under no circumstances will you be permitted or entitled to obtain awards for, and hereby waive all rights to claim, incidental or consequential damages. The prior limitation on damages is not intended to limit Sponsor’s obligation (if any) to pay prevailing party costs or fees if recoverable pursuant to applicable law.
WINNER’S LIST/OFFICIAL RULES: The name of the winning Entrant (parent/legal guardian) may be obtained on or about September 30, 2026 by sending an email with the subject line "Ultimate Mark Rober Rivian Contest” to ultimateroberrivian@rivian.com. Requests for Official Rules must be received during the Entry Period; requests for the winner list must be received on or before April 1, 2027.
