PLEASE READ THESE OFFICIAL RULES CAREFULLY BEFORE ENTERING. BY ENTERING (OR OTHERWISE PARTICIPATING) IN THE SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH CREATE A CONTRACT. WITHOUT LIMITATION, SUCH CONTRACT INCLUDES GRANTS OF RIGHTS AND INDEMNITIES TO SPONSOR FROM YOU, A CLASS ACTION WAIVER, AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.
1. General. This Rivian Snow Mode 2025 Promotion (“Promotion”) is sponsored by Rivian, LLC, 14600 Myford Rd., Irvine, California 92606 (“Sponsor”). This Promotion consists of a series of individual sweepstakes (each, a “Sweepstakes”). Specific details on the Entry Period and Prize(s) (each as defined below) and any other terms applicable to a particular Sweepstakes and not specified in these Official Rules will be detailed in an announcement posted together with any invitation to enter the Sweepstakes (the “Sweepstakes Announcement”). Each Sweepstakes in the Promotion is subject to these official rules (“Official Rules”), inclusive of all additional details and terms set forth in the Sweepstakes Announcement for the applicable Sweepstakes – all of which are incorporated herein by reference. Each Sweepstakes is separate and distinct from the others in this Promotion and entry into any one Sweepstakes does not constitute an entry into any other Sweepstakes.
2. Agreement to Official Rules. All participation in any Sweepstakes shall be governed by these Official Rules. By participating (or attempting to participate) in any Sweepstakes, you fully and unconditionally agree to be bound to and accept these Official Rules and any additional terms and conditions specific to the Sweepstakes communicated by Sponsor or any of the Promotion Entities (defined below). You further agree to be bound to the decisions of the Sponsor (and its authorized representatives), which are final and binding in all matters related to the Promotion.
3. Eligibility. Unless otherwise specified in the applicable Sweepstakes Announcement, each Sweepstakes in this Promotion is open only to individuals who: (i) have reached the age of majority in their state of residence at the time of entry into the applicable Sweepstakes (the age of majority is 18 in most states, but 19 in Alabama and Nebraska and 21 Mississippi); (ii) are a legal resident of one of the fifty United States or the District of Columbia (Puerto Rico, Guam, the Virgin Islands and other United States territories are ineligible) (the “Territory”); (iii) physically reside in the Territory; and (iv) possess a government-issued taxpayer identification number (e.g., Social Security Number).) Eligibility and prize claims are subject to verification by Sponsor. This Promotion is only open to natural persons and the following are ineligible: corporations, businesses, non-profit organizations, governmental agencies or other entities or groups. Employees, officers, directors, agents, and representatives of Sponsor and any of its affiliates, parent, subsidiaries, contractors, advertising and sweepstakes agencies, any prize provider, and any other party involved in the development, administration, promotion or fulfillment of the Promotion (collectively, along with Alterra Mountain Company, the “Promotion Entities”), together with the immediate families (spouses, parents, children, siblings, and their respective spouses) and those living in the same household (whether or not related) of any such person are not eligible to enter.
4. Entry Period. Each Sweepstakes begins at 12:00:00 am Eastern Time (“ET”) on the start date specified in the Sweepstakes Announcement for that Sweepstakes and ends at 11:59:59 pm PT on the end date specified in the Sweepstakes Announcement. (For each Sweepstakes, this period is referred to as the “Entry Period” and, for the purpose of these Official Rules, the “Promotion Period” refers to the period between the start of the first Sweepstakes and the conclusion of the final Sweepstakes.) Sponsor’s computer shall be the official timekeeper for all matters related to this Promotion.
5. How to Enter. No purchase or payment is necessary to enter or to win. No purchase or payment is necessary to enter or to win. During the Entry Period for a Sweepstakes, eligible participants may enter that Sweepstakes by visiting the website URL provided with the Sweepstakes Announcement and/or available by scanning the QR code in the Sweepstakes Announcement (the “Promotion Site”) and following the instructions to complete and submit the online entry form, including providing all required information and agreeing to these Official Rules. Eligible participants who complete and successfully submit the entry form for a Sweepstakes during its Entry Period will receive one (1) entry into that Sweepstakes (an “Entry”).
Limit one (1) Entry per person and per email account in each Sweepstakes; multiple Entries will not be accepted. Submitting (or attempting to submit) multiple entries into a Sweepstakes by any means – including, without limitation, through the use of multiple sets of contact information – may, in Sponsor’s sole discretion, result in disqualification from the Sweepstakes. (Without limiting the foregoing, a single eligible entrant may enter multiple Sweepstakes comprising this Promotion, subject to this one-entry-per-Sweepstakes limitation.) No other forms of entry into the Sweepstakes will be permitted. Unless otherwise provided by Sponsor, all Entries become the property of Sponsor and will not be returned to Entrants.
Entries must be submitted and received by Sponsor during the Entry Period for the applicable Sweepstakes in strict accordance with the instructions and restrictions in the Sweepstakes
Announcement and these Official Rules. Entries that are not timely received by Sponsor will not be entered into the Sweepstakes. For purposes of this Promotion, an Entry is “received” when the server(s) operating the Promotion Site log successful submission of a completed entry form. Other proof of submitting or attempting to submit an Entry (such as, without limitation, a screenshot of your purported Entry submission) does not constitute proof of actual receipt of the Entry for purposes of this Promotion. Those who do not abide by these Official Rules or the instructions of Sponsor or its representatives and provide all required information may, in Sponsor’s sole discretion, be disqualified and any Entry by such person void. Entries that are fraudulent, forged, incomplete, lost, late, misdirected, illegitimate, incomprehensible, garbled, or generated by a macro, bot, script, or other automated means will not be accepted and will be void. Sponsor reserves the right to restrict or void Entries or other participation from any IP address or other identifiable source if any suspicious entry and/or participation is detected. Entries or participation made on your behalf by another, made by you on behalf of any other individual, made by any entity or group, or originating at any online service other than the Promotion Site (including, without limitation, through commercial promotion subscription, notification, or entering services) will be declared invalid and disqualified for this Promotion. As a condition of entering any Sweepstakes in this Promotion – and without limiting any other provision in these Official Rules – each entrant gives consent for Sponsor and its agents to obtain and deliver his or her name, address, and other information and content to third parties for the purpose of administering the Promotion and complying with applicable laws, regulations, and rules – including, without limitation, publishing such information on a winners list in accordance with these Official Rules. If any person supplies false information, obtains Entries by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain a Prize, Sponsor may disqualify that person and seek damages from them and that person may be prosecuted to the full extent of the law. In the event of a dispute concerning the identity of an entrant, the entrant will be declared to be the registered account holder of the email address provided in the applicable Entry, but only if that person meets all eligibility criteria, otherwise the Entry may, in Sponsor’s sole discretion, be disqualified and any potential prize won will be forfeited. A registered account holder is defined as the natural person who is assigned to an email address by the online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the applicable email address. Any potential winner may be required to provide Sponsor with proof that they are the registered account holder of the email address associated with the potentially winning Entry. If a dispute cannot be resolved to Sponsor’s satisfaction, the Entry will be deemed ineligible
6. Winner Selection via Random Drawing. Within approximately fourteen (14) business days following the end of the Entry Period for each Sweepstakes, Sponsor or its representative will select, from all eligible entries received, one potential winner (each a “Potential Winner”) for each available Prize as described in the Sweepstakes Announcement. Each Potential Winner is subject to verification, as described below. Odds of winning depend on the number of eligible entries received for the applicable Sweepstakes.
7. Prize.
The prize(s) available in a particular Sweepstakes (any a “Prize”), as well as additional details, conditions, and terms applicable to that Prize and the approximate retail value (“ARV”) of the Prize, will all be as detailed in the Sweepstakes Announcement for that Sweepstakes.
Prizes may be subject to additional terms and conditions imposed by their issuers. If the Prize consists of or includes any skiing lift tickets, these additional terms and conditions include those imposed by the operator of the applicable venue and/or issuer of the lift ticket. If the Prize consists of or includes an IKON Pass, these additional terms and conditions include all terms imposed by the IKON Pass issuer, including, without limitation, those set forth here: www.ikonpass.com/en/purchase-terms-and-conditions
Any and all taxes on the Prize, as well as costs associated with acceptance or use of such Prize and not set forth in the Sweepstakes Announcement or these Official Rules as being included in the Prize, will be the sole responsibility of the winner, as further detailed below. Sponsor will not be liable to any winner for a difference between the ARV of a Prize as set forth in the Sweepstakes Announcement for the applicable Sweepstakes (or any other Sweepstakes-related materials) and the actual value of such Prize as awarded.
All Prize details not specifically stated in the Sweepstakes Announcement or otherwise in these Official Rules will be determined by Sponsor and prize providers in their sole discretion. Where applicable, mailed Prize components will only be mailed to the confirmed winner’s address within the Territory, unless Sponsor agrees otherwise in its sole discretion. If a winner does not accept or use the entire Prize, the unaccepted or unused part of the Prize will be forfeited and Sponsor will have no further obligation with respect to that Prize or portion of the Prize. Sponsor is not responsible for any inability of any Potential Winner or winner to accept or use any Prize (or portion thereof) for any reason. Winner is strictly prohibited from selling, auctioning, trading or otherwise transferring the right to receive any part of a Prize, except with Sponsor’s permission, which may be granted or withheld for any reason in its sole discretion. No transfers, prize substitutions or cash redemptions will be made, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute any stated Prize or portion thereof with another prize or portion thereof of equal or greater value for any reason, including, without limitation, prize unavailability. For each Sweepstakes, no more than the stated Prize(s) will be awarded. Entrants waive the right to assert, as a cost of winning any Prize, any and all costs of verification and redemption or travel to claim or use the Prize and any liability and publicity which might arise from claiming or seeking to claim said Prize.
Each Prize is provided as-is, without any warranty, representation, or guarantee (express or implied, in fact or in law, whether now known or hereinafter enacted) relative to the use or enjoyment of the Prize, including, without limitation, its quality, merchantability, or fitness for a particular purpose.
8. Claiming the Prize. Following the drawing for the applicable Sweepstakes, each Potential Winner will be notified of their selection in an initial notification e-mail. Potential Winner must follow the Prize claim instructions provided as part of the initial notification and any subsequent claim instructions, otherwise the Prize will be forfeited in its entirety. Winning is subject to verification of eligibility, including verification of age, and compliance with all terms and conditions of these Official Rules (including the Sweepstakes Announcement for the applicable Sweepstakes). Failure to respond to the initial notification within five (5) days (or other timeframe as set forth by Sponsor in the initial notification) may, in Sponsor’s sole discretion, result in disqualification of that Potential Winner. To claim the Prize, Potential Winner may be required to sign and return within five (5) days (or other timeframe specified by Sponsor), an Affidavit/Declaration of Eligibility, General Liability and Publicity Release (except where/as prohibited by law), Tax Liability Waiver, and a Form W-9 or other tax documents required by Sponsor in its discretion (collectively the “Winner Documents”). If (i) any Potential Winner cannot be contacted after Sponsor has made a reasonable attempt, does not respond to any communication from Sponsor by the applicable deadline, fails to complete, sign, and return all Winner Documents within the required time period (if requested), or if any prize notification is returned as undeliverable, (ii) if the Potential Winner rejects its Prize, or (iii) if a Potential Winner is determined or suspected to have not complied with these Official Rules, such Potential Winner may (in Sponsor’s discretion ) be disqualified and any potential Prize forfeited, without notice or any further obligation or liability to such Potential Winner. In any such case, an alternate Potential Winner may be selected from all remaining eligible Entries, if time permits. For each Prize, Sponsor will not be obligated to pursue more than three (3) alternate winners (time permitting) for any reason, in which case that Prize may go unawarded.
Prizes, if legitimately claimed, will be awarded. Sponsor will endeavor to deliver the applicable Prize to each confirmed winner within thirty (30) days of final verification of that winner.
Promotion Entities are not responsible for any undelivered emails, messages or any other communications, including but not limited to those that are not received because of Potential Winner’s privacy or spam filter settings that may divert any email, message or other Promotion-related communication to a spam or junk folder.
Entrants agree to permit any of the Promotion Entities to contact them concerning the Sweepstakes.
9. Taxes. Each winner is solely responsible for any and all federal, state, municipal and local taxes, fees and other government assessments associated with receipt and use of a Prize or participation in this Promotion. Each winner may be issued a Form 1099-MISC (if required) showing prize ARV as income to winner. Federal and state withholding laws are subject to change without notice and Sponsor may, where applicable, withhold part of any Prize in compliance with any then-applicable withholding laws at the time of Prize award.
10. General.
a. Sponsor reserves the right in its sole discretion to disqualify any individual who: (i) tampers or attempts to tamper with the operation of the Promotion or any Sweepstakes, including the Entry process, the Promotion Site, or any other Sponsor site or platform; (ii) violates the Official Rules; or (iii) acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
b. Promotion Entities are not responsible for any incorrect or inaccurate information, whether caused by website users, human error, tampering, hacking or by any of the equipment or programming associated with or utilized in the Promotion and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission (including availability or accessibility of the Internet), incompatibility, communications failure, theft, loss or destruction of Entries, nor for the failure to capture Entry or other information. Promotion Entities are not responsible for injury or damage to Entrants’ or to any other person’s computer or mobile device related to or resulting from use of the Promotion Site or any other participation in the Promotion. If, for any reason, the Promotion or any element thereof – including any individual Sweepstakes – is not capable of running as planned for any reason (including, without limitation, tampering, unauthorized intervention, fraud, force majeure, technical or other failures or errors, or any other causes similar or dissimilar which Sponsor deems, in its sole opinion, could corrupt or affect the administration, security, fairness, integrity or proper conduct of the applicable Sweepstakes or the Promotion itself), Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend any affected Sweepstakes (or the entire Promotion) and – as applicable – select the winner(s) from non-suspect, eligible entries received in a particular Sweepstakes prior to termination or as otherwise may be deemed fair and equitable by Sponsor. In the event there is an alleged or actual ambiguity, discrepancy, or inconsistency between disclosures or other statements contained in any Promotion-related materials (including any Sweepstakes Announcement) and/or these Official Rules (including any alleged ambiguity, discrepancy, or inconsistency within these Official Rules), it will be resolved by Sponsor in its sole discretion. Entrants waive any right to claim ambiguity in the Promotion or these Official Rules.
c. Reference to any third party or third party’s trademark is for identification purposes only and does not imply endorsement by, association with, or approval of this Promotion by such party.
11. Publicity Release. By participating in any Sweepstakes, you grant (and agree to confirm that grant in writing, if necessary) Sponsor or Sponsor’s authorized representatives the right to use your Entry, name, biographical information, likeness, image, voice, statements, and any other personal attribute protectable under applicable law for promotional, trade, commercial, and publicity purposes, at any time or times, in all media now known or hereafter discovered, including television, internet and social media, worldwide, without notice, review or approval and without additional notice, compensation or consent, except where prohibited by law.
12. Privacy. Information submitted in connection with the Promotion will be treated in accordance with these Official Rules and the Sponsor’s Data Privacy Notice and General Terms, which may be amended from time to time and are currently located at https://rivian.com/legal/privacy and https://rivian.com/legal/terms, respectively. By submitting an Entry, you agree to be contacted by Sponsor with Promotion-related communications. The information you provide will be used as stated herein and the aforementioned policies, and for purposes of this Promotion. (Entrants may opt-out of any marketing communications from Sponsor at any time without such opt-out affecting their Entry.)
13. Release. By participating, each Entrant agrees to release and hold harmless Sponsor and all other Promotion Entities from any injury, loss, or damage of any kind to person (including disability or death) or to property, arising from or related to – in-whole or in-part, directly or indirectly – (a) acceptance or use/misuse of the Prize or (b) preparing for, traveling to, or participation in any Promotion- or Prize-related activity. Without limiting the foregoing, each winner specifically recognizes and understands that use of certain skiing-related or other Prizes may involve inherent danger and the assumption of related risks and each winner further accepts and agrees that no Promotion Entity will have any liability to that winner or any party that may take by or through such winner for any injury, loss, or damage that such winner or any guest of such winner may suffer in making use of such prize (including, without limitation, permanent disability or death) and expressly releases each Released Party from any and all potential liability relating thereto.
Entrant further acknowledges that they may be waiving rights with respect to claims that are at this time unknown or unsuspected. In accordance with such waiver, Entrant acknowledges that they have read, understand, and hereby expressly waive the benefits of Section 1542 of the Civil Code of California and any similar law of any state or territory that may apply to them. Section 1542 reads as follows: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
This Sweepstakes is intended for viewing in the United States only and shall be construed and evaluated only according to United States law. Do not enter this Sweepstakes if you are not located in the United States and, more specifically, comply with eligibility requirements in Section 3. The use of any automated devices in connection with this Sweepstakes is prohibited. Sponsor assumes no responsibility for computer system, hardware, software, or program malfunctions or other errors, failures, delayed computer transactions, or network connections, whether human, technical, or otherwise in nature. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should virus, bugs, or other causes beyond its control corrupt the administration, security, or proper play of this Sweepstakes. Sponsor is not responsible for any injury or damage to any person’s computer or related equipment resulting from or relating to participation in this Sweepstakes or downloading/uploading any material related to this Sweepstakes. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of Entry. In the event of a dispute, the Potential Winner may be required to provide proof that he or she is the authorized holder of the identified e-mail account.
14. Disputes/Limitation of Liability/Choice of Law. EXCEPT WHERE PROHIBITED, EACH ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION (INCLUDING ALL SWEEPSTAKES) OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION AS DESCRIBED IN SPONSOR’S TERMS OF USE FOUND AT rivian.com/legal/terms (2) CALIFORNIA LAW, WITHOUT REFERENCE TO CHOICE OF LAW RULES, GOVERNS THE PROMOTION AND ALL ASPECTS RELATED THERETO, (3) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED TO PARTICIPATE IN THE PROMOTION, BUT IN NO EVENT ATTORNEYS’ FEES, (4) NO PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS (COLLECTIVELY, “SPECIAL DAMAGES”) MAY BE AWARDED, AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF (PROVIDED THAT NOTHING IN THESE OFFICIAL RULES WILL RESTRAIN A CALIFORNIA RESIDENT’S RIGHT UNDER APPLICABLE LAW (IF ANY) TO SEEK PUBLIC INJUNCTIVE RELIEF OTHERWISE IN ACCORDANCE WITH THE DISPUTE-RESOLUTION PROCEDURES SET OUT IN SPONSOR’S TERMS OF USE), AND (5) ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM SPECIAL DAMAGES OR TO HAVE TO ANY DAMAGES MULTIPLIED OR INCREASED.
15. Force Majeure. Without limiting any other provision in these Official Rules, the Promotion Entities are not responsible or liable to any Entrant or winner (or any person claiming through such Entrant or winner) for interruption or termination of any or all Sweepstakes, or failure to supply any Prize or any part thereof, in the event that any of the Promotion activities or Promotion Entities’ operations are affected by any cause or event beyond the sole and reasonable control of the applicable Promotion Entity (as determined by Sponsor in its sole discretion), including, without limitation, by reason of any acts of God, threatened or actual terrorist acts or acts of public enemy, armed conflict or war (declared or undeclared), civil disturbance, insurrection, riot, pandemic/epidemic or similar public-health crisis, fire, explosion, earthquake, flood, hurricane, unusually severe weather, blackout, embargo, equipment failure, labor dispute or strike (whether legal or illegal), work slow-down, labor or material shortage, transportation interruption of any kind, any law, rule, regulation, action, order, or request adopted, taken, or made by any governmental or quasi-governmental entity (whether or not such governmental act proves to be invalid), or any other cause, whether or not specifically mentioned above.
16. Severability. The invalidity, illegality, or unenforceability of any provision of these Official Rules shall in no way affect the validity, legality, or enforceability of any other provision hereof. Any invalid, illegal, or unenforceable provision shall be deemed severed from these Official Rules and the balance of these Official Rules shall be construed and enforced as if these Official Rules did not contain such invalid, illegal, or unenforceable provision.
17. Winner’s List. A copy of these Official Rules will be available at [https://events.rivian.com/snowmodeterms] during the Promotion Period. To obtain the name of the winners of any Sweepstakes, send an email to customerservice@rivian.com within ninety (90) days of the end of the Promotion Period. The email must contain “Rivian Snow Mode 2025 Promotion – WINNERS LIST” in the “subject” field and the body of the email must include sufficient indication of the particular Sweepstakes about which you’re requesting winner information (e.g., entry dates and/or name of ski resort at which you saw the Sweepstakes advertised).
